Kick’em Training Facility Rental Agreement

This Facility Rental Agreement is made between Kick'em Training Facility (referred to as the "Owner") and the individual or organization (referred to as the "User") that is completing the rental application at https://www.kickemtrainingfacility.com.

The Property subject to rental in this agreement is defined as the indoor field or any part of it. The Owner promises that the Property will be in a clean and fully functional condition at the start of the agreement. If the Property is returned to the Owner in a less clean or functional condition, the User will be charged a cleaning fee of $60 per hour plus the cost of maintenance, repair, and damages, unless the damage is the result of the Owner's act or omission.

This agreement is effective immediately and ends at the end of the rental period selected by the User. The total rental fee must be paid in full by the User before the use of the facility. If the User's payment does not clear the Owner's bank, the agreement will be terminated automatically. Rental rates are subject to change.

The User and any participants, employees, or third parties who enter the Facility or Property during the rental period must abide by the rules of the Facility. The User must have and maintain general liability insurance that names the Owner as an additional insured, with a coverage limit of not less than $1,000,000 per occurrence, covering personal injury and property damage. The User must provide the Owner with a certificate of insurance that states that the User's policy is primary and non-contributory and, if the rental involves sports activities, that it covers participant's legal liability.

The User assumes and agrees to be fully and exclusively responsible for the safety of the persons and property of all participants in the events during the Rental Period, including, without limitation, employees, participants, associates, guests, spectators, and any members of the public in attendance at any of the events being held by the User at the facility. The User shall defend, indemnify, and hold the Owner, its officers, employees, and agents harmless from and against any and all liability, loss, expense, including reasonable attorneys’ fees, or claims for injury or damages arising out of the performance of this Agreement but only in proportion to and to the extent such liability, loss, expense, attorneys’ fees, or claims for injury or damages are caused by or result from the negligent or intentional acts or omissions of the User, its officers, agents, employees, participants, associates, guests, spectators and any members of the public in attendance at any of the events being held by the User at the facility.

Each participant (or their parent or legal guardian for minors) must execute and acknowledge the Owner's Waiver and Release, releasing the Owner from any claims for personal injury or damage to property arising from the rental. The User acknowledges that they had the opportunity to inspect the facility and that it is in acceptable condition for its rental. The User also authorizes to allow participants’ photograph, picture, likeness, and voice to appear in any documentaries, promotions, or media coverage of the league, tournament, or practices without compensation. Both the Owner and the User acknowledge that they have the authority to enter into this agreement, have read and understand its terms and conditions, and agree to abide by the rules and guidelines set forth.
